Use of the Service
These Terms of Service govern your use of TrakRite, a subscription-based software platform designed to help process serving companies monitor PST jobs, automate notifications, and streamline operational workflows.
By using TrakRite, you agree to use the platform in accordance with applicable laws and to maintain accurate account information and system settings that support your business operations.
PST API Authorization
To connect TrakRite with your Process Server's Toolbox (PST) account, you will be asked to provide your PST API credentials.
By providing these credentials, you authorize TrakRite to securely access the information necessary to deliver the features you have enabled, including job monitoring, notifications, messaging, reporting, and related services.
You are responsible for ensuring that you are authorized to provide these credentials and that their use complies with your organization's policies and any applicable agreements.
Your Responsibilities
To help ensure the best experience with TrakRite, you agree to:
- Keep your account information current and accurate.
- Maintain the confidentiality of your login credentials.
- Ensure notification recipients and contact information remain up to date.
- Review and configure system settings that affect monitoring and notification behavior.
- Use the platform in compliance with applicable laws and your organization's policies.
If your organization has internal privacy, security, or operational requirements regarding access to PST data, you are responsible for ensuring those requirements are satisfied before connecting your account.
Third-Party Services
TrakRite integrates with third-party services, including Process Server's Toolbox (PST), email providers, SMS providers, payment processors, cloud hosting services, and other technology partners.
While we work to provide a reliable and dependable platform, the availability and performance of certain features may be affected by third-party systems that are outside of our control. Temporary service interruptions, maintenance, API changes, carrier filtering, or other external factors may occasionally impact data synchronization or notification delivery.
Operational Responsibility
TrakRite is designed to assist with monitoring, communication, and workflow automation. It is intended to complement, not replace, your organization's operational processes.
You remain responsible for reviewing job activity, confirming service status, and making business decisions based on your own records and the information available within PST.
Limitation of Liability
We strive to provide a reliable, secure, and dependable service. However, like any cloud-based software platform, TrakRite cannot guarantee uninterrupted availability or error-free operation under all circumstances.
To the fullest extent permitted by applicable law, TrakRite shall not be liable for indirect, incidental, consequential, special, or business interruption damages arising from the use of the platform, including delays or interruptions caused by third-party services, communication providers, customer configuration choices, or circumstances beyond our reasonable control.
Account Security
We take reasonable measures to help protect your account and data. Features such as encrypted connections (HTTPS/TLS), authentication safeguards, and optional two-factor authentication (2FA), where available, are provided to enhance account security.
You are responsible for maintaining the confidentiality of your login credentials and for restricting access to your account. If two-factor authentication is available, we strongly encourage you to enable it for additional account protection.
If you believe your account has been compromised or you become aware of any unauthorized access, please notify us promptly so we can assist in securing your account.
Billing and Subscription
Certain TrakRite services are provided through paid subscription plans. By subscribing, you authorize the payment method associated with your account to be charged for applicable subscription fees in accordance with your selected plan.
Subscription billing and payment processing are handled through secure third-party payment providers. TrakRite does not store your complete payment card information.
Unless otherwise stated, subscriptions automatically renew at the end of each billing period until canceled. You may manage or cancel your subscription through your account settings, and your access to paid features will continue through the end of the current billing period unless otherwise specified.
Suspension and Termination
You may discontinue your use of TrakRite at any time. We reserve the right to suspend or terminate access to the Services if these Terms are materially violated, if use of the platform is unlawful, or if continued access would pose a security or operational risk.
Termination of your account does not relieve either party of obligations that, by their nature, should survive termination, including payment obligations, limitations of liability, and applicable legal rights.
Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our Services, applicable laws, or business practices.
When material changes are made, the updated version will be published within TrakRite and may require acceptance before certain account management features are modified or new services are enabled.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
