Review the terms that apply to text messaging notifications, consent, delivery, and carrier limitations.

SMS/Text Messaging Terms

Consent to Receive Text Messages

TrakRite may send text message notifications when SMS features are enabled within your account. These messages may include job alerts, status notifications, server reminders, comment-based messages, account-related notices, and other system-generated communications related to your use of TrakRite.

By enabling SMS features or configuring recipients to receive text messages through TrakRite, you represent that you have the authority to send those messages and that any required consent from recipients has been obtained.

Message Frequency

Message frequency varies based on your account settings, job activity, alert conditions, and messaging workflows enabled in TrakRite.

The number of messages a recipient receives may depend on factors such as overdue attempts, status changes, owner alerts, server reminders, direct messages entered through PST comments, and other configured notification rules.

Message and Data Rates

Message and data rates may apply depending on the recipient's mobile carrier plan.

TrakRite does not charge recipients directly for receiving SMS messages, but carriers may apply standard messaging or data charges.

Recipient Communications

TrakRite SMS notifications are automated system messages. Unless otherwise indicated, recipients should not reply to these messages.

If a recipient wishes to stop receiving messages, they should contact the organization that sent the message. Organizations using TrakRite are responsible for maintaining recipient lists and honoring requests to discontinue messaging in accordance with applicable laws and their business practices.

Customer Responsibilities

You are responsible for the phone numbers, recipient lists, message templates, notification settings, and workflows configured in TrakRite.

You agree to use SMS features only for lawful business purposes and to avoid sending messages to recipients who have not consented, who have opted out, or who should no longer receive messages from your organization.

You are also responsible for ensuring that your organization's use of SMS messaging complies with applicable laws, carrier requirements, industry guidelines, and your internal business policies.

TrakRite sends SMS notifications to the phone numbers made available through PST and/or configured within TrakRite. In some cases, PST may provide a business or office phone number rather than a mobile number. Customers are responsible for ensuring that phone numbers stored in PST are accurate, SMS-capable, and appropriate for receiving text notifications.

Carrier Delivery and Reliability

TrakRite works with third-party messaging providers and mobile carriers to deliver SMS notifications. While TrakRite is designed to support timely communication, SMS delivery is not guaranteed.

Messages may be delayed, filtered, blocked, or fail due to carrier restrictions, recipient device issues, inaccurate phone numbers, registration requirements, messaging provider outages, network conditions, or other factors outside TrakRite's reasonable control.

No Emergency or Sole-Reliance Use

TrakRite SMS notifications are intended to support business workflow communication and operational awareness. They should not be used as the sole method for time-sensitive, emergency, legal-deadline, or mission-critical communications.

You remain responsible for reviewing job activity, confirming service status, and using appropriate backup communication methods when necessary.

Changes to SMS Terms

We may update these SMS/Text Messaging Terms from time to time to reflect changes in our services, messaging requirements, carrier rules, laws, or business practices.

When material changes are made, the updated version will be published within TrakRite and may require acceptance before certain SMS-related settings or account management features are modified.

Limitation of Liability

To the fullest extent permitted by applicable law, TrakRite is not liable for indirect, incidental, consequential, special, or business interruption damages arising from delayed, failed, blocked, filtered, or undelivered SMS messages, third-party messaging provider issues, mobile carrier actions, recipient opt-outs, inaccurate phone numbers, or customer configuration choices.
